End User License Agreement (EULA)

⚠️ Important: Please read these Terms and Conditions carefully before using any application published by Appica Ltd. (each an "App", collectively the "Apps"). By downloading, installing, or using any of our Apps, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing and using any App published by Appica Ltd., you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use the App.

2. Description of Service

Appica Ltd. develops and publishes mobile applications for iOS, including utility apps, games, and other tools. Each App is designed to perform the specific function described in its App Store listing.

2.1 Service Features

Core functionality as described in each App's App Store listing
Locally stored preferences and, where applicable, saved data or progress
Premium subscription features, where offered by a particular App

3. User Eligibility and Account

3.1 Age Requirements

You must be at least 13 years old to use any of our Apps. If you are under 18, you must have parental or guardian consent to use the App.

3.2 Account Responsibility

Where an App requires or offers an account, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Acceptable Use Policy

You agree to use our Apps only for their intended purpose and in accordance with all applicable laws.

4.1 Prohibited Activities

You agree NOT to use any of our Apps to:

Violate any local, state, national, or international laws
Infringe on intellectual property rights
Attempt to reverse engineer, decompile, or modify the App
Use the App for any malicious or harmful purposes
Circumvent any security features, access restrictions, or subscription controls
Interfere with or disrupt the App's functionality or servers

5. Intellectual Property Rights

5.1 App Ownership

Each App and all its components, including but not limited to software, design, text, graphics, and other materials, are owned by Appica Ltd. and are protected by copyright and other intellectual property laws.

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use each App for your personal, non-commercial use, subject to these Terms.

6. Subscription Terms

6.1 Premium Subscriptions

Certain Apps may offer premium subscription plans with enhanced features. Where offered, subscription options, pricing, and included features are described within the relevant App and its App Store listing.

6.2 Billing and Payment

Subscriptions are charged through your Apple ID account
Payment is charged to your iTunes/Apple Account at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period

6.3 Free Trial

Free trial periods, where offered, will automatically convert to a paid subscription unless canceled before the trial period ends.

6.4 Cancellation

You can manage and cancel subscriptions at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.

7. Refund Policy

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. Refund requests must be submitted directly to Apple through the App Store.

7.1 Refund Eligibility

Refunds may be requested within the applicable refund window as defined by Apple's policies
Free trial cancellations made before the trial period ends will not incur charges
Subscription refunds are handled on a case-by-case basis by Apple
Technical issues that prevent app functionality may be eligible for refunds

7.2 How to Request a Refund

Visit Apple's Report a Problem page
Sign in with your Apple ID
Find the subscription or purchase
Select "Request a refund" and follow the instructions

8. Privacy Policy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Technical Requirements

9.1 Internet Connection

Some Apps or App features may require an active internet connection. We are not responsible for any charges from your internet service provider.

9.2 Device Compatibility

Our Apps are designed for iOS devices and require compatible hardware and software versions as specified in the App Store listing for each App.

10. Disclaimers and Limitations

10.1 Service Availability

We do not guarantee that any App will be available at all times or that it will function without interruption.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPICA LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES ARISING FROM YOUR USE OF ANY APP.

11. App Store Compliance

Use of our Apps is also subject to Apple's applicable terms, including the Apple Media Services Terms and Conditions. We reserve the right to modify App functionality in response to changes in Apple's platform terms or technical requirements.

12. Termination

12.1 Termination by User

You may stop using any App at any time and cancel your subscription through your Apple ID Account Settings.

12.2 Termination by Us

We may terminate or suspend your access to an App immediately, without prior notice, if you breach these Terms or engage in prohibited activities.

13. Updates and Modifications

13.1 App Updates

We may release updates to improve functionality, security, or compliance. Continued use of an App after an update constitutes acceptance of any changes.

13.2 Terms Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website. Continued use of any App constitutes acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Appica Ltd. is registered, without regard to conflict of law principles.

16. Additional Terms

16.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16.2 Entire Agreement

These Terms constitute the entire agreement between you and Appica Ltd. regarding the use of our Apps and supersede all prior agreements and understandings.

By using any App published by Appica Ltd., you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
